What Happens After Arrest?
After arrest a bond is set by a Magistrate Judge. Some serious offenses require a Superior Court Judge to set bond. Posting bond is the best first step to improve the outcome of a case. Bonds can be posted with cash or property or a combination of both. If bond was denied or the bond was set too high we can help you get bond or a bond reduction.
What is Arraignment?
Arraignment is the first court appearance made by a Defendant. Notice is sent by mail to the address of record with the clerk of court. At Arraignment, the Defendant is called upon to enter a plea of either guilty or not guilty. Upon release from custody, check with the clerk of court to make sure your address is correct. Failure to appear at Arraignment will lead to an arrest warrant. Having an attorney at Arraignment is crucial because important legal rights can be lost if they are not asserted at the time of Arraignmentat or before Arraignment. If you must attend Arraignment without a lawyer then ask for a public defender before you enter any plea at Arraignment.
What is Motion Hearing?
Motions are requests filed in advance of trial to settle a variety of concerns. The most common motions are discovery and suppression case. Every Judge has his or her own system for motion hearings and some have them months before trial and some have them minutes before trial.
Will My Case Go To Trial?
We believe that Trial has to be a real option in every case, so we begin each case by preparing it for trial. All of our cases don't go to trial but we believe that accepting a case for the purpose of just arranging a plea bargain is the wrong approach. Great results don't come easily and they usually come from a position of strength. Showing the government that you are ready and capable of trying the case is the key to every successful outcome.
